Rules of the program
These rules and provisions (the “Rules”) aim to regulate the PepperMill & Friends program (the “Program”), promoted by PepperMill Genk BV with registered seat at Europalaan 75, 3600 Genk, Belgium and with company number 0460.929.746 (“Friends”).
The Rules apply to any person or entity of whatever form (each an “Applicant”) who wishes to apply to participate in the Program.
Article 1 – Purpose
- The Program aims to promote the development of communities, and supporting social, cultural, and sports projects (each a “Project”). This includes providing assistance to amateur athletes, groups of amateur athletes or collective entities, with projects that require support for their implementation and/or maintenance. Friends decides in its discretion which projects to support, and may change its vision / strategy of the Program, and/or the focus of its initiatives under the Program from time to time.
- The Program is purely socio-cultural in nature.
- Applications to obtain support under the Program are voluntary and free of charge.
- The Program focuses on supporting the creation of conditions that are necessary to pursue the objectives that underpin the Project. To be eligible for the Program, and for your Project to be supported under the Program, the Project must meet the eligibility conditions listed in article 3 of these Rules.
- Participation in the Program subjects all Applicants (and their respective organizations), the applications submitted, and the selected Projects to these Rules. By applying, the Applicant (and/or their organization) unconditionally accepts these Rules and provides express consent, affirming that they have read, understood, and agreed to abide by them. Any terms or conditions proposed by the Applicant or their organization are expressly excluded and shall not apply.
- Any personal data submitted by the Applicant and collected by Friends will be processed in accordance with Friends’ standard data privacy and processing policy, a copy of which will be provided to the Applicant. By applying, the Applicant expressly consents to the processing of their relevant personal data for the purposes of administrating and executing the Program, including its duration and associated activities such as marketing initiatives, media coverage, and related operations.]
- Friends may grant, under its Program, and as it sees fit, financial, logistical, technical or other support.
- 8. The duration of the support under the Program will be discussed between Friends and the Applicant, and may be subject to achievement of certain milestones. The Program can be optionally prolonged, at Friends’ discretion. In the case of prolongation, new milestones may be defined. Support under the Program can be terminated unilaterally under the terms as agreed between the parties.
Article 2 – Who can participate
Applicants can consist of any person or entity supporting a socio-cultural, and/or sports, initiative. Examples include the following. Amateur athletes or groups of amateur athletes, of legal age (no upper age limit imposed), registered or not with Official Bodies representing any competition or club. Secondly, legal entities that fulfill an objective to promote the development of communities and/or play a significant role in it. Thirdly, any collective entities (pursuing socio-cultural initiatives) that apply in the manner established in these Rules.
Article 3 – General conditions for application to the Program
- Candidates must complete the application form available on the website
www.peppermillandfriends.be, providing the following data: - Identification of the person or persons involved, such as the amateur athlete, group of amateur athletes or social collective entity
- Story of the applicant
- Milestones and proposed Initiative
- Letter of motivation
- Description of the type of support for which the Applicant applies
- Provision of images or other materials demonstrating the authenticity of the request
- Testimonials of support for the Applicant(s) (optional)
- Declaration of veracity and authorization for processing of data for the specific purposes of the Program (by accepting the specific privacy terms as applicable from time to time)
- Declaration of authorization for the disclosure of name, images and sounds.
- Each Applicant may only participate with one application and only in a single modality/Project.
- All Friends employees and people directly involved with the Program are prohibited from participating in the Program.
Article 4 – Selection of applications
- Applications will be evaluated by personnel specifically selected for / appointed by Friends. This team (and Friends) may choose to invite external elements to join this selection panel.
- The selection will be made independently and impartially. Each Project will be classified with reference to the following selection criteria:
- The Applicant’s or organisation's personal / general history
- The milestone(s) set to achieve
- The challenges and obstacles to achieve these milestones
- Obstacles/difficulties experienced in pursuing the milestone(s)
- Type of support considered necessary to achieve the milestone(s)
- Estimated costs for the achievement of the Project that the Applicant or entity is proposing
- Calendar within the scope of the Project (optional)
- Applicants may be contacted during the Project evaluation process to collect additional information. Friends’ decision may be subject to the Applicant’s willingness to provide timely and sufficient additional information in order to allow Friends to fully evaluate the Project.
- The value and type of support awarded to each Project will be determined by Friends, in accordance with the evaluation criteria indicated in point 2 of this article.
Article 5 – Deadlines for applications
Applications can be submitted at any time
Article 6 – Obligations of the Applicants
Applicants that benefit from the Program are obliged to:
- Be available to participate in promotional activities within the scope of the Program;
- Be available to use the Program brands and respective logos on all socio-cultural, sports, promotional, and other related materials (including online materials such as websites and social media);
- Provide evidence of the results of the initiatives carried out within the scope of the Program;
- Inform Friends about the event calendar and other potential promotional activities.
Article 7 – Use of the Name, Image, and Voice of the amateur athlete, group of amateur athletes, or social entity.
Applicants and/or the collective social entities that benefit from the Program authorize the Program / Friends to:
- Use the Applicants / organisation’s name, image, and sound records in any promotional vehicle chosen to publicize this Program;
- The authorizations described above do not imply any disclosure, or payment of any amount by the Program.
Article 8 – Some general principles
- Friends reserves the right to transfer, assign, or delegate the Program, in whole or in part, to any third party at its sole discretion without prior notice to the Applicants.
- Friends may collaborate or partner with any third party to further the objectives of the Program. Such partnerships do not alter the obligations or rights of the Applicants as outlined in these Rules.
- Applicants must comply with all applicable advertising, sponsorship, and promotion laws, as well as Friends' specific guidelines, when promoting their participation in the Program or any related activities.
- Friends reserves the right to terminate the Applicant’s participation in the Program, with immediate effect, if the Applicant breaches any provision of these Rules or engages in behavior deemed inappropriate, unethical, or detrimental to the Program’s purpose.
- Participation in the Program does not guarantee the provision of support, financial or otherwise, unless explicitly agreed to in writing by Friends.
- Friends reserves the right to amend, update, or modify these Rules at any time, with immediate effect. Such amendments will be communicated through the official Program channels.
- Friends will not be held liable for any delay or failure to fulfill its obligations under the Program due to circumstances beyond its reasonable control, including but not limited to natural disasters, government actions, or pandemics.
- Friends shall not be held responsible for the actions or omissions of third parties, including partners or service providers, involved in the execution of the Program.
- Any materials or deliverables created within the scope of the Program remain the property of Friends unless otherwise explicitly agreed in writing.
- Any disputes arising in connection with the Program shall be subject to the jurisdiction of the courts of Ghent, Belgium and governed by the laws of Belgium.
